These Terms of Use ("Terms") govern your access to and use of the website operated by Metropolitan Property Group ("MPG," "we," "us," "our") at themetropolitanpropertygroup.com (the "Site"), and any related forms, listings, communications, or lead-generation channels, including Facebook and Instagram Lead Ads and Messenger. By accessing the Site or submitting an inquiry, you agree to be bound by these Terms. If you do not agree, do not use the Site.
Metropolitan Property Group is a Michigan-based commercial real estate and business brokerage firm led by Broker Johnny Gjokaj, providing commercial real estate brokerage, business brokerage, investment sales, and confidential business sale services throughout Southeast Michigan. Nothing on the Site constitutes an offer to sell, or a solicitation of an offer to buy, any security, business interest, or real property in any jurisdiction where such offer or solicitation would be unlawful.
Browsing the Site, submitting an inquiry, responding to a Lead Ad, or messaging MPG through Messenger or Instagram Direct does not create a brokerage, agency, fiduciary, or client relationship between you and Metropolitan Property Group. A brokerage relationship is established only through a separate, signed written agreement (such as a listing agreement, buyer representation agreement, or engagement letter). Until such an agreement is executed, MPG owes you no fiduciary duty and information you share is treated in accordance with our Privacy Policy and Confidentiality Policy, but does not by itself establish representation.
Property listings, business opportunity summaries, financial highlights, photographs, and related materials published on the Site are provided for general informational purposes to prospective buyers, sellers, and investors. You may not republish, redistribute, scrape, or use listing content for any commercial purpose other than your own evaluation of a potential transaction with MPG, without our prior written consent. Confidential business listings are subject to the additional restrictions described in Section 6 and our Confidentiality Policy.
Property and business information presented on the Site — including square footage, income and expense figures, lease terms, financial performance representations, and business valuations — is obtained from the property owner, business seller, public records, or other third-party sources believed to be reliable. MPG has not independently verified this information and makes no warranty, express or implied, as to its accuracy or completeness. Prospective buyers and their advisors are responsible for conducting independent due diligence, including verification of financial statements, lease terms, permits, licenses, zoning, and environmental conditions, before relying on any information in connection with a transaction decision. Many listings, particularly business acquisition opportunities, are confidential. Business names, locations, financial statements, offering memorandums, and other proprietary materials are released only after execution of a Non-Circumvention, Non-Disclosure & Confidentiality Agreement (NCNDA). Submitting a form does not guarantee access to confidential materials. MPG reserves the right to qualify buyers, at its sole discretion, before releasing confidential information. Any confidential information you do receive is subject to the terms of the applicable NCNDA and our Confidentiality Policy, and you agree not to circumvent MPG or contact a seller, landlord, or business directly outside the process MPG establishes.
All content on the Site — including text, graphics, logos, photographs, listing descriptions, and the overall look and feel — is owned by or licensed to Metropolitan Property Group and is protected by U.S. copyright, trademark, and other intellectual property laws. Except as necessary to evaluate a potential transaction, you may not copy, modify, distribute, or create derivative works from Site content without our prior written permission.
You agree not to: (a) submit false, misleading, or fraudulent information in any form; (b) use the Site to transmit unlawful, defamatory, or infringing content; (c) attempt to circumvent MPG to deal directly with a seller or buyer identified through a confidential listing; (d) interfere with the Site's operation, scrape data, or introduce malicious code; or (e) impersonate any person or misrepresent your affiliation with any entity.
Information you submit through contact forms, buyer or seller inquiries, valuation requests, or Lead Ads is used by MPG as described in our Privacy Policy. You represent that the information you submit is accurate and that you have the right to share any business or property information you provide to us.
The Site may link to or integrate with third-party platforms, including Meta (Facebook/Instagram), DocuSign, and Netlify. MPG does not control and is not responsible for the content, terms, or privacy practices of third-party platforms.
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. MPG does not warrant that the Site will be uninterrupted, error-free, or secure.
To the fullest extent permitted by Michigan law, Metropolitan Property Group and its broker, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenue, arising from or related to your use of the Site or reliance on any information contained on it, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to indemnify and hold harmless Metropolitan Property Group and its broker, agents, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site, violation of these Terms, or submission of false or misleading information.
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Oakland County, Michigan, and you consent to the personal jurisdiction of such courts.
We may revise these Terms at any time by posting an updated version on this page. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
